Online store regulations

The Regulations define the rules of using the noxvoid.com website, in particular the conditions for placing orders, concluding and implementing sales contracts, and the rights and obligations of the Seller and the Buyer.

The provisions relating to sole proprietors who have been granted consumer protection ("entrepreneur with consumer rights") apply to contracts concluded from 1 January 2021.

§ 1. Definitions

  • Working days – Monday–Friday, excluding public holidays.

  • Consumer – a natural person who enters into a legal transaction with the Seller that is not directly related to his or her business or professional activity.

  • Entrepreneur with consumer rights – a natural person conducting business activity, concluding a contract related to its activity but not of a professional nature (pursuant to Article 38a of the Act on Consumer Rights).

  • Buyer – any entity placing an order in the Store (both Consumer and entrepreneur).

  • Shop – online service available at noxvoid.com.

§ 3. Technical conditions

To use the Store you must:

  1. a device with Internet access,

  2. an up-to-date browser that supports JavaScript and cookies,

  3. active e-mail address (for placing orders).


§ 4. Orders and conclusion of contracts

  1. The prices given in the Store are gross prices (including all taxes).

  2. Delivery costs are added to the price of the goods if they apply to a given order.

  3. To make a purchase, the Buyer selects the goods, delivery method, payment method and provides the data necessary to complete the order.

  4. The sales contract is concluded upon confirmation of the order by the Buyer.

  5. The Seller confirms the conclusion of the contract by sending an e-mail or upon delivery of the goods.

  6. The Buyer may create an Account in the Store or make purchases without registration.


§ 5. Payments

  1. Available payment methods:

    • payment card (Visa, MasterCard),

    • BLIK,

    • fast online transfers (Przelewy24, Shopify Payments).

  2. When choosing online payment, payment must be made within 2 business days of placing the order.

  3. The Buyer accepts the issuance of invoices in electronic form (with the possibility of withdrawing consent).


§ 6. Order fulfillment and delivery

  1. The Seller delivers goods free from defects, which in the case of personalized 3D prints are always goods made to individual orders.

  2. The delivery time is given for each product and is counted in business days.

  3. In the case of payment in advance, execution takes place after the funds have been credited.

  4. If the order includes several products with different delivery times, the entire order will be shipped according to the longest delivery time.

  5. Deliveries are made only within Poland, via courier companies.


§ 7. Withdrawal from the contract

  1. The consumer and the entrepreneur with consumer rights may withdraw from the contract within 14 days of receiving the goods, without giving any reason.

  2. To exercise the right of withdrawal, you must send a declaration (e.g. e-mail or letter) to the Seller's contact details.

  3. You may use the withdrawal form (Annex 1), but this is not obligatory.

  4. The Seller will refund all payments received (including the costs of the cheapest standard delivery) within 14 days of receiving information about the withdrawal.

  5. Refunds will be made in the same manner in which the payment was made, unless the parties agree otherwise.

  6. The Buyer returns the goods within 14 days of being informed of the withdrawal – at his/her own expense (unless the goods require special transport due to their size – then the costs are indicated by the Seller).


§ 8. Limitations on the right of withdrawal

The right of withdrawal does not apply, among others, in the case of contracts:

  • for goods made to individual order,

  • for perishable goods,

  • delivered in sealed packaging that cannot be returned once opened for hygiene reasons,

  • audio-video recordings, computer programs in a sealed package after opening,

  • press, magazines (except subscriptions),

  • when the price depends on market fluctuations beyond the Seller's control.


§ 9. Complaints

  1. Goods may be advertised under the warranty provisions of the Civil Code or on the basis of the guarantee granted.

  2. The Buyer may request, among other things, repair of the goods, replacement, price reduction or withdrawal from the contract (in the case of a significant defect).

  3. Complaints can be submitted by e-mail or by post (address in § 2).

  4. The Seller is not liable for the costs of delivering the advertised goods by the consumer/privileged entrepreneur.

  5. Complaints are considered within 14 days.


§ 10. Personal data

  1. The administrator of personal data is the Seller.

  2. The data is processed to fulfil orders, handle complaints and – with consent – for marketing purposes.

  3. Detailed data protection rules are included in the Privacy Policy available in the Store.

  4. The Buyer has the right to access, correct, delete, limit processing, transfer and object to data.

  5. In the event of a violation of the law, a complaint may be filed with the President of the Personal Data Protection Office.


§ 11. Final provisions

  1. It is prohibited to provide illegal content.

  2. Each order constitutes a separate sales contract.

  3. Contracts are concluded in Polish.

  4. In disputes with customers who are not consumers, the competent court is the one at the Seller's registered office.

Terms and Conditions of Use of the Account in the Noxvoid Store

Provisions regarding the privileged entrepreneur

The protection provided for in these Consumer Regulations also extends to individuals conducting business activity who enter into a contract with the Seller in connection with that activity, provided that the contract is not of a professional nature for them. These provisions apply only to contracts concluded from 1 January 2021.

§ 1 CONCEPTS

  • Consumer – a natural person defined in accordance with the Civil Code.

  • Account – a free functionality of the online store that allows the Buyer to, among other things, manage data, track order status and view purchase history.

  • Buyer – any entity making a purchase in the Store.

  • Privileged Buyer – Consumer and Privileged Entrepreneur.

  • Privileged entrepreneur – a natural person conducting business activity, concluding a contract not directly related to the professional nature of this activity.

  • Regulations – this document regulating the rules of using the Account.

§ 3 TECHNICAL REQUIREMENTS

To use the Account you need:

  1. a device with Internet access,

  2. active e-mail account,

  3. an up-to-date web browser with JavaScript and cookies support.


§ 4 RULES OF USING THE ACCOUNT

  1. Creating an Account by the Buyer is voluntary.

  2. Registration takes place by completing the registration form in the Store.

  3. Upon creation of the Account, an Account management agreement is concluded for an indefinite period.

  4. The Buyer may cancel their Account at any time, free of charge, by sending a message to support@noxvoid.com . Cancellation will result in immediate deletion of the Account.


§ 5 COMPLAINTS PROCEDURE

  1. Complaints regarding the functioning of the Account can be submitted by e-mail to the following address: support@noxvoid.com .

  2. The Seller will consider the complaint within 14 days of its receipt.

  3. If the complaint is rejected, the Consumer has the right to use extrajudicial methods of dispute resolution, including:

    • mediation conducted by the Provincial Inspectorate of Trade Inspection,

    • permanent consumer arbitration court at the IH Inspectorate,

    • assistance from the municipal or district consumer ombudsman,

    • ODR platform: https://ec.europa.eu/consumers/odr


§ 6 PERSONAL DATA PROTECTION

  1. The administrator of personal data is the Seller.

  2. The data is processed for the purpose of maintaining the Account – the basis is the contract (Article 6, paragraph 1, letter b of the GDPR) and the legitimate interest of the Seller (Article 6, paragraph 1, letter f of the GDPR).

  3. Providing data is voluntary, but necessary to maintain the Account.

  4. The data will be processed until:

    • deletion of the Account,

    • expiration of the possibility of pursuing claims,

    • effectively object to processing.

  5. The Buyer has the right to request: access, rectification, deletion, limitation, transfer of data, as well as to object to processing.

  6. In the event of unlawful processing, the Buyer may file a complaint with the President of the Personal Data Protection Office.


§ 7 FINAL PROVISIONS

  1. It is prohibited to provide illegal content.

  2. The Account management agreement is concluded in Polish.

  3. The Seller may change the Regulations for important reasons, in particular:

    • adaptation to changes in law,

    • improving the security of services,

    • modification of the functionality of the Account.

  4. The buyer will be notified of any changes at least seven days before they take effect. Failure to object constitutes acceptance of the changes.

  5. Disputes with a Buyer who is not a privileged Buyer will be resolved by the court having jurisdiction over the Seller's registered office.

 

 

Terms and Conditions of the Noxvoid Newsletter Service

Provisions regarding the privileged entrepreneur

The provisions applicable to Consumers apply accordingly to Privileged Entrepreneurs. These rights apply to contracts concluded from 1 January 2021.

§ 1 CONCEPTS

  • Consumer – a consumer within the meaning of the Civil Code.

  • Newsletter – an electronic service consisting in the Service Provider sending messages to the indicated e-mail address, containing information about the offer, promotions and new products in the Store.

  • Privileged entrepreneur – a natural person conducting business activity who concludes a contract unrelated to the professional nature of this activity.

  • Service Recipient – any entity using the Newsletter.

  • Privileged Service Recipient – Consumer and Privileged Entrepreneur.

§ 2 RULES FOR USING THE NEWSLETTER

  1. Subscription to the Newsletter is voluntary and free of charge.

  2. To use the service, you need a device with internet access, an up-to-date browser that supports cookies and JavaScript, and an active email address.

  3. The newsletter is sent to the e-mail address provided during registration.

  4. The contract is concluded when you subscribe to the Newsletter using the form available in the Store.

  5. The Service Recipient is obliged to provide a correct e-mail address.

  6. You can unsubscribe from the Newsletter at any time by sending a message to support@noxvoid.com . Unsubscribing will result in immediate termination of the service agreement.


§ 3 COMPLAINTS

  1. Complaints related to the functioning of the Newsletter should be reported by e-mail to the following address: support@noxvoid.com .

  2. The service provider will consider the complaint within 14 days.

  3. If a satisfactory solution is not reached, the Consumer has the right to use out-of-court dispute resolution methods (IH mediation, arbitration court, consumer ombudsman, ODR platform).


§ 4 PERSONAL DATA

  1. The administrator of personal data is the Service Provider.

  2. The data is processed for the purpose of providing the Newsletter service – the basis is the contract (Article 6 paragraph 1 letter b of the GDPR) and the legitimate interest of the Service Provider (Article 6 paragraph 1 letter f of the GDPR).

  3. Providing data is voluntary, but necessary to provide the service.

  4. Data is processed until:

    • unsubscribe from the Newsletter,

    • limitation of claims,

    • effectively object to processing.

  5. The Service User has the right to: access, rectify, delete, limit, transfer data and object to processing.

  6. A complaint about unlawful processing may be filed with the President of the Personal Data Protection Office.


§ 5 FINAL PROVISIONS

  1. It is prohibited to provide content that is illegal.

  2. The Newsletter service agreement is concluded in Polish.

  3. The Service Provider may change the regulations in the event of:

    • changes in legal regulations,

    • modernization of the Newsletter service.

  4. Notice of changes will be sent to the Service User's email address at least 7 days before the changes take effect. Failure to object constitutes acceptance.

  5. In the event of a dispute with a Service User who does not have privileged status, the competent court will be the court with jurisdiction over the registered office of the Service Provider.
